Swanson Health Products Refer A Friend Terms and Conditions

Swanson Health Products ("we," "SwansonVitamins.com," or "Company") may offer individuals the opportunity to refer friends through the Refer A Friend Program ("Program"). We reserve the right to terminate the Program at any time for any reason.

Participants in this Program are bound by the Terms and Conditions defined below. By participating in the Program, individuals agree to use the Program in the manner specified in these Terms and Conditions henceforth. If you do not agree with these Terms and Conditions in their entirety you are not eligible to register as an "Advocate" (defined below) or participate in the Program in any manner. Individuals may not participate in the Program where doing so would be prohibited by any applicable law or regulations.

We reserve the right to modify or amend at any time these Terms and Conditions and the methods through which Rewards are earned. We reserve the right to disqualify any individual at any time from participation in the Program, if he/she does not comply with any of these Terms and Conditions.

1. Privacy

Individuals ("Advocates") may participate in the Program to recommend services or content made available by Swanson Health Products to their friends, family members or peers ("Friends"). To do this, Advocates must necessarily submit personal information about themselves and their friends, family members or peers, such as name and email address information so that the Company can send these communications on their behalf. The personal information will be collected, processed and used in accordance with Swanson Health Products' privacy statement, which can be found at www.swansonvitamins.com/helpdesk/security-privacy.html. Additionally, personal information may be used by the Company to contact individuals with regards to their participation in the Program and to receive communications from Company. Where an individual provides personal information about its friends, family members or peers to receive communications via the Program, the personal information will be used by the Company for sending these communications on behalf of the individual. Participants understand that the Company may send out additional follow up communications on behalf of the Advocate to encourage or remind family members, friends or peers to purchase or complete the Refer A Friend process.

2. How the Refer A Friend Program Works

General information
To participate, visit http://www.swansonvitamins.com/referral/ and follow the steps to refer family members, friends or peers to the Program by entering names and email addresses in the Refer A Friend form. Advocates may refer a maximum of 24 friends, family members or peers during a twelve month period.

Individuals who refer are called "Advocates." Individuals who receive a referral are called "Friends." An "eligible" Advocate who is fully compliant with these Terms and Conditions may receive "Referral Reward Coupons" for every "Valid Referral."

Eligible Advocate
To be "eligible" an Advocate must:

  1. be a legal resident of the United States of America;
  2. be at least 18 years old; and
  3. be a currently registered customer who has ordered from Swanson Health Products within the last 6 months.

Swanson Health Products employees or any members of its affiliates, subsidiaries or promotional agencies, including immediate family or household members, are not eligible to participate in the Refer A Friend Program.

How to Make a Referral

An Advocate must be a currently registered customer (who has placed an order within 6 months) to make a referral, but no purchase is required to make a referral. Once an individual refers a friend, family member or peer, he/she becomes an Advocate and will receive a unique referral link ("Personal URL or Link") that allows the Advocate to receive credit for Valid Referrals. Personal URLs or Links will be issued to individuals only. Each Advocate will also be provided with a unique and personal section in the My Account section of swansonvitamins.com—their personal page—where Valid Referrals can be viewed and managed.

Advocates must respect the spirit of the Refer A Friend Program by only referring real individuals who meet the requirements stated herein. Advocates cannot refer themselves or members of their household with same physical address; multiple or fake accounts cannot be created with Swanson Health Products. Multiple or fake email addresses or identities cannot be used in this Program.

Valid Referrals
A Valid Referral means that all of the following conditions are met:

  1. Friend completed the registration process and the minimum $20 purchase with Swanson Health Products using the Advocate's "Personal URL or Link." If a Friend purchases or registers with Swanson Health Products using any other link or method, the registration will not count as a Valid Referral and the Advocate will not earn credit or reward;
  2. Friend was not previously registered with Swanson Health Products under any email address or alias within 24 months;
  3. Friend is a legal resident of the United States of America and is at least 18 years old; and
  4. Friend is not a member of the Advocate's household with same physical address; and
  5. only one Valid Referral can be earned for each Friend up to a maximum of twenty four Friends during a twelve month period. Any additional or subsequent purchases made by a Friend will not be Valid Referrals.

Reward for Valid Referrals
Rewards can only be awarded for Valid Referrals.

How to Earn Rewards
Advocate will receive one (1) reward valued at $10 dollars for each verified Valid Referral generated by the Advocate. An Advocate may not earn more than 24 Valid Referrals per twelve month period or more than $240 dollars in rewards per twelve month period.

Rewards ("Referral Reward Coupons") may be redeemed on future purchases only.

Verified Valid Referrals
Rewards are subject to verification. Swanson Health Products may delay a Reward for the purpose of investigation. We may also refuse to verify and process any transaction we deem, in our sole discretion, to be fraudulent, suspicious or in violation of these Terms and Conditions, or believe will impose liability on Swanson Health Products, or any of our respective officers, directors, employees, representatives or agents.

All decisions by the Company are final and binding, including decisions as to whether a Valid Referral, Credit or Reward is verified.

Transfer and Value of Rewards
Rewards have no monetary value and may not be redeemed for cash. Rewards are not transferable and may not be auctioned, traded, bartered or sold. Upon termination of the Refer A Friend Program or any portion thereof for any reason, or upon cancellation of an Advocate's Swanson Health Products account for any reason, any unredeemed Rewards accumulated by the Advocate are forfeited. Swanson Health Products reserves the right to limit redemption of rewards. Coupons may not be used solely to purchase delivery insurance, charitable donations or gift certificates.

3. Content Use, Ownership and Publicity

All content, including but not limited to images, text, design, logos, icons and computer code, is the property of Swanson Health Products and is protected under copyright, trademark and other laws. Participants are authorized, subject to these Terms and Conditions, to use the Refer A Friend Program solely for personal, non-commercial use. Unauthorized use may violate copyright, trademark and applicable communications, regulations and statutes and is strictly prohibited. Written permission is required to display or use any trademark material, except as enabled by any link provided by Swanson Health Products.

Participation in the Refer A Friend Program or acceptance of the Reward constitutes "permission" within the Program. Participants thereby grant Swanson Health Products permission to use profile information, including but not limited to biographical information, first name, last name and statements, for any and all promotional or advertising purposes in all forms without review, permission or further compensation of any amount, where permitted by law.

4. Liability

By participating in the Program, Participants agree to:

The Company disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with the Program, and reserves the right, in our sole discretion, to cancel, modify or suspend the Program should a virus, bug, computer problem, unauthorized intervention or other causes beyond the Company's control, corrupt the administration, security or proper play of the Program.

Swanson Health Products shall not be liable to any participants for failure to supply Reward or any part thereof, by reason of any acts of God, equipment failure, civil disturbance, natural disaster, fire, labor dispute, war, or any other cause beyond the Company's control.

The Company reserves the right to cancel or suspend the Refer A Friend Program should it become compromised in any way.

5. Fraudulent and Suspicious Behavior

No mechanically reproduced forms permitted. Automated entries are prohibited, and any use of such automated devices will cause disqualification. We reserve the right, at our sole discretion, to prohibit an individual from participating in the Program or receiving a Reward, if such individual is tampering with or attempting to undermine the fairness, integrity or legitimate operation of the Program in any way. We reserve the right to cancel or suspend this Program should fraud, virus, bug, prohibited conduct or other causes beyond the control of Company corrupt the administration, security or proper use of Program. Swanson Health Products is not responsible for computer system, phone line, hardware, software or Program malfunctions, or other error failures or delays in computer transmissions or network connections that are human or technical in nature. Proof of entering information on our website is not considered proof of delivery or receipt by Company.

Individuals may not enter multiple or fake email addresses, use fictitious identities or aliases or use any system, device, bot or other device to participate in the Program or receive a reward.

Bulk Distribution or "SPAM"

If an Advocate provides a personal link to a Friend by email, the email must be created and distributed in a personal manner that is appropriate and customary for communication with friends, family members and peers. By submitting email address and other personal information, the Advocate represents that he/she has prior consent.

Bulk email distribution, distribution to strangers or any other promotion of a personal URL or link in a manner that would constitute or appear to be unsolicited commercial email or "spam" by the Company's sole discretion is expressly prohibited. Advocates who distribute "spam" will be prohibited from participating in the Program and all rewards will be forfeited.

Each Advocate is the actual sender of emails and must comply with applicable law. Advocates who do not comply with the law, including anti-spam laws, are obligated to indemnify Swanson Health Products against any liabilities or costs it incurs as a result of such spam. Any attempt to deliberately undermine or damage this Program may be in violation of criminal and civil laws. Should an attempt be made, the Company reserves the right to seek damages to the fullest extent of the law.

6. Credentials

Individuals must create an account to participate in the Refer A Friend Program and are responsible for keeping sign-in credentials confidential and for any activity associated with the account. Swanson Health Products is not liable for any loss or damage arising from unauthorized use of sign-in credentials.

7. Applicable Law

Any and all disputes, claims and causes of action arising out of or related to the Program or any reward shall be resolved under North Dakota law, and participants in the Program agree to submit any dispute to the exclusive jurisdiction of the state and federal courts located in Cass County, North Dakota.

Participants and Company agree to submit to the personal and exclusive arbitration of any disputes relating to the use of Program under the rules of the American Arbitration Association. Any such arbitration, to the extent necessary, shall be conducted within Cass County in the state of North Dakota. Participants assent not to sue the Company in any other forum.

8. General Terms

These Terms constitute the entire agreement between Participants and the Company concerning use of the Program. The failure of the Company to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect. These Terms are for the benefit of Participants and Company only.
